Terms of Service

These are my standard terms of service for any design project. Amendments and alterations can be discussed and agreed before our project starts.

1. Payment

  1. a. I reserve the right to request a 15% deposit prior to proceeding with our project, to be discussed and agreed in advance of starting work. If a deposit is requested, an invoice will be generated and delivered to you via email. By remitting deposit funds you are accepting these Terms of Service.
  2. b. I will invoice for the remaining cost of our project and associated services prior to the release of any final creative work and associated files. I reserve the right to withhold delivery until payment has been received in full.
  3. c. I reserve the right to invoice prior to a previously agreed date if you have been uncontactable/unresponsive for more than 30 days.
  4. d. You may reserve the right to request a payment plan which may be accepted at my discretion. All payment plans must be agreed to by both parties in writing.
  5. e. Unless agreed otherwise, all payments due to Matt Tams are to be made within 30 days of an invoice being issued.
  6. f. I reserve the right to charge for any fees incurred relating to commencement of collection and recovery processes for accounts that remain unpaid in excess of 30 days.

2. Ownership

  1. a. The final creative work will become your property only upon final payment of our project. I reserve the right to withhold delivery until payment has been received in full. If final payment is not received as agreed, all creative work will remain the property of Matt Tams until payment is received.
  2. b. These Terms of Service do not give you the rights or permission to use/modify/alter/replicate/borrow any of the unselected ideas/concepts/sketches that I present. All unselected original artwork, files, sketches, visuals, ideas and related materials shown and considered will remain the property of Matt Tams.
  3. c. I am free to use such unselected original works for future conceptual and client work. Where this retains visual similarities to a final creative work that you now own, I shall repurpose/restyle this in such a way that the end design is sufficiently different as to not cause conflict or confusion.
  4. d. Unless otherwise agreed and arranged, I reserve the right to showcase the final creative work and associated designs in my portfolio, on personal platforms such as social media, and in any number of online galleries/portfolios/showcases/awards as well as in printed literature including books and magazines, now and in the future.
  5. e. Once the final creative work becomes your property, you are free to change, modify and adapt the contents as you see fit, but do so at your own risk.

3. Cancellation

  1. a. If you choose to cancel the project midway through, where ideas and proposals have been submitted, refund of previous payment is not possible. However, depending on the work completed and overall budget, a portion of the funds may be returned.
  2. b. If I fall ill, or I am otherwise unable to complete the project due to unforeseen circumstances, a portion of the overall budget will be returned based on work completed to date. In such circumstances, if creative work so far completed can be used for another designer to continue the project, I will make reasonable attempts to support this.
